DUI Driving Record

     Records of a DUI arrest and/or conviction remain in criminal history files for the rest of your life. A DUI committed more than seven years after a prior conviction is treated as a first offense, as far as penalties are concerned.  Convictions and license revocations remain on your full DMV record for the rest of your life. 

     DMV reports DUI convictions to insurance companies and employers for three years. A DUI license revocation is reported until the driving privilege is reinstated.

 

 

Two Separate Proceedings

     If you do not request a hearing within the designated time period, you forfeit any right to contest the license suspension and it will automatically take effect. The court proceedings are completely independent of The Nevada DMV's suspension. The former is a criminal proceeding and the latter is simply an administrative proceeding.  They are independent of each another, however, if you plead guilty or "no contest" in court to the criminal charge, the DMV hearing becomes moot: Your will have a suspended license.

Below you will find the specfic penalties issued by Nevada DMV surrounding the administrative DMV conviction case.

  • License revoked for 90 days
  • $65 Reinstatement Fee
  • $35 Victims Compensation Civil Penalty
  • $21.75 Driver License Fee
  • DMV Tests – Vision, Knowledge, possibly Skills
  • SR-22 Certificate of Liability Insurance required for three years.

A driver license revocation is a separate action from any criminal case. Motorists may appeal a revocation through the DMV Office of Administrative Hearings. License reinstatement is not automatic, even if the criminal charges were reduced or dismissed. You must meet reinstatement requirements and physically obtain a license to regain your driving privilege. A revocation which is not reinstated will remain on your record indefinitely and you will not be able to obtain a driver license in any state.

  • insurance company can receive reports from the DMV for up to three years
  • your auto insurance will most likely increase in cost quite dramatically, 
  • in some cases your insurance policy may be terminated by the insurance company
  • you may be forced to get insurance from a different company that offers less coverage for more money
  • [as above] you will be required to get an SR-22 Certificate of Liability Insurance required for three years.
